Noon Energy Privacy Policy

This Privacy Policy describes the policies and procedures of Noon Energy Inc., a Delaware corporation (“we”, “our” or “us”) on the collection, use and disclosure of your information on https://www.noon.energy/ (the “Site”) and any services, features, content or applications we offer on the Site or through our owned and operated social media accounts (collectively with the Site, the “Services”).  We receive information about you from various sources, including: (i) if you complete and submit information via the “Get in Touch” box; (ii) your use of the Services generally; and (iii) from third party websites and services.  When you use the Services, you acknowledge that your information will be collected, transferred, manipulated, stored, disclosed and used as described in this Privacy Policy.

For the purposes of the General Data Protection Regulation (EU) 2016/679 including as it applies in the UK pursuant to the European Union (Withdrawal) Agreement 2018 (collectively the “GDPR”), Noon Energy Inc. is the data controller and is responsible for your Personal Information.

What Does This Privacy Policy Cover?

This Privacy Policy covers the treatment of personally identifiable information (“Personal Information”) expressly provided by you to us by filling out the “Get in Touch” box or gathered by us when you are using or accessing the Services. 

The term “Personal Information” as used in this Privacy Policy includes any information that enables us to identify you, directly or indirectly, by reference to an identifier such as your name, identification number, location data, online identifier or one or more factors specific to you.
 

What Information Do We Collect and How Do We Use It?

The information we gather enables us to personalize, improve and continue to operate the Services.  In connection with certain aspects of the Services, we may request, collect and/or display some of your Personal Information.  We collect the following types of information from our users.
 

“Get In Touch” Box Information:

If you complete and submit the Get in Touch section of our Website, you could choose to provide information that would be Personal Information, such as personal identifiers that include your name, your email address, and your phone number.  We may from time to time contact you using that Personal Information unless you subsequently tell us not to.  For example, we may from time to time list open positions, and if you choose to contact us via “Get in Touch” box and state that you have interest in one of our open positions, we may in response contact you to gather more Personal Information in order to determine if there is a fit  including employment-related information, such as, educational background, work history, and interests.  You acknowledge that this information may be personal to you, and by completing the “Get in Touch” box, providing Personal Information to us, you will not be anonymous.  We may use your contact information to contact you and to send you information about Noon Energy and our products and services and our open positions, but only when we feel such information is important, or where you have given your consent (if required under applicable law). Should we do so, you may unsubscribe from these messages by following the “Unsubscribe” or “Manage Email Preferences” link at the bottom of any promotional email.

We will store your Personal Information in a form that permits us to identify you for no longer than is necessary for the purpose for which the Personal Information is processed.  We store your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements and rights, or if it is not technically and reasonably feasible to remove it.  Otherwise, we will seek to delete your Personal Information within a reasonable timeframe or earlier upon request.
 

Information From Other Sources:

We may also collect Personal Information from other sources, such as data that is publicly available or collected from other third parties. Personal Information obtained from such other sources will be handled in accordance with this Privacy Policy.
 

IP Address Information and Other Information Collected Automatically:

  • We may automatically receive and record information from your web browser when you interact with the Services, including your IP address and information obtained from cookies and similar technologies (placed with your consent, where required by applicable law).  This information is used for fighting spam/malware and also to facilitate collection of data concerning your interaction with the Services (e.g., what links you have clicked on).

  • Generally, the Site collects usage information, such as the number and frequency of visitors to the Site.  We may use this data in aggregate form, that is, as a statistical measure, but not in a manner that would identify you personally.  This type of aggregate data enables us and third parties authorized by us to figure out how often individuals use parts of the Services so that we can analyze and improve them.

  • We may collect some device-specific information if you access the Services using a mobile device.  Device information may include but is not limited to unique device identifiers, network information, and hardware model, as well as information about how the device interacts with our Services.

We may receive a confirmation when you open an email from us.  We use this confirmation to improve our customer service.
 

Information Collected Using Cookies and Similar Technologies:

  • Cookies are pieces of text that may be provided to your computer through your web browser when you access a website.  Your browser stores cookies in a manner associated with each website you visit.  We use cookies (with your consent, where required by applicable law) to enable our servers to recognize your web browser and tell us how and when you visit the Site and otherwise use the Services through the Internet.  The cookies we use on the Site are as follows:

    • Session cookies: These temporary cookies expire and are automatically erased whenever you close your browser window.  We use session cookies to grant our users access to content and to enable actions they must be logged in to do.

    • Persistent cookies: These usually have an expiration date in the distant future and remain in your browser until they expire or you manually delete them.  We use persistent cookies to better understand usage patterns so we can improve the site for our customers.  For example, we may use a persistent cookie to associate you with your email or internet address or to remember your choices on the Site.

    • Third party cookies: We permit limited third parties to place cookies through the Site to provide us with better insights into the use of the Site or user demographics.  These third parties may collect information about your online activities over time when you use our Site.  For example, we utilize analytics provided by Wix, our webhost and website platform provider, to analyze usage patterns of the Site.  Wix analytics generates a cookie to capture information about your use of the Site which Wix uses to compile reports on website activity for us.  Wix may use a portion of your IP address to identify their cookie, but this will not be associated with any other data held by Wix.

  • Our cookies do not, by themselves, contain Personal Information, and we do not combine the general information collected through cookies with other Personal Information to tell us who you are.  As noted, however, we do use cookies to identify that your web browser has accessed aspects of the Services and may associate that information with your email address if you provide it to us via the “Get in Touch” box.

  • In addition to the ability to update your preferences via our Site, most browsers have an option for turning off the cookie feature, which will prevent your browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways. 

  • We may also permit third parties to place cookies through the Site, as indicated above, to perform analytic or marketing functions.  Contractually, these third parties are required to use this information only for our benefit, although we cannot actually control what they do with your information. 
     

Information Related to Advertising Directed at European Residents

By providing your Personal Information in a “Get in Touch” box, you are consenting to our contacting you.  You can choose to stop receiving direct marketing or other communications from us at any time simply by following the “Unsubscribe” or “Manage Email Preferences” link at the bottom of any promotional email we may in the future send to you.
 

Aggregate Information

We collect statistical information about how both unregistered and registered users, collectively, use the Services, for example the number of people that applied for a role and/or the fact that the role was filled (“Aggregate Information”).  Some of this information is derived from Personal Information.  This statistical information is not Personal Information and cannot be tied back to you or your web browser.
 

Minors and Children’s Privacy
Our service is not designed for or intended to be used by individuals under the age of 13, nor do we knowingly collect or receive Personal Information of individuals under 13. If you are not 13 years or older, do not use our Services, including any Sites or pages which are integrated into our Services, at any time or in any manner. If we learn that Personal Information of persons less than 13 years-of-age has been collected through our Service, we will take the appropriate steps to delete this information.
 

How, and With Whom, Is My Information Shared?

We do not share your Personal Information or any other information you provide us in the “Get in Touch” box with any third party.  We will not serve you with advertisements of any third party.


IP Address Information:

While we collect and store IP address information, that information is not made public.  We do at times, however, share this information with our partners, service providers and other persons with whom we conduct business, and as otherwise specified in this Privacy Policy.
 

Email Communications with Us:

As part of the Services, you may occasionally receive email and other communications from us in response to your query or about Noon Energy and its products and services. 


User Profile Information:

User profile information including your username and other information you enter may be displayed to other users to facilitate user interaction within the Services.


Information Shared with Our Agents:

We employ and contract with people and other entities that perform certain tasks on our behalf and who are under our control (our “Agents”) such as a webhosting service.  We may need to share Personal Information with our Agents in order to provide products or services to you. Our Agents do not have any right to use Personal Information or other information we share with them beyond what is necessary to assist us.

Where we use Agents to process your Personal Information on our behalf, they will be required to agree, by contract or otherwise, to process Personal Information in accordance with applicable law.  This contract will stipulate, among other things, that the Agent and its representative shall act only on our instructions, or as permitted by law.


Information Disclosed Pursuant to Business Transfers:

If we, or substantially all of our assets, were acquired, or if we go out of business or enter bankruptcy, user information would be one of the assets that is transferred or acquired by a third party (subject to any existing opt outs relating to the selling or sharing of your Personal Information). You acknowledge that such transfers may occur, and that any acquirer of us or our assets may continue to use your Personal Information.
 

Information Disclosed for Our Protection and the Protection of Others:

We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce this Privacy Policy and our Terms of Service, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect our rights, property or safety, our users and the public.  This includes exchanging information with other companies and organizations for fraud protection and spam/malware prevention.
 

Is Information About Me Secure?

We otherwise store all of our information, including your IP address information, using industry-standard techniques.  We do not guarantee or warrant that such techniques will prevent unauthorized access to information about you that we store, Personal Information or otherwise.


What Privacy Rights Do I Have?

Registered and unregistered users can access and delete cookies through their web browser settings.

 

Your Rights. You may have certain rights and choices regarding our processing of your Personal Information. Depending on your jurisdiction, applicable law may entitle you to additional consumer rights, including the right:

  • To know the categories and/or specific pieces of Personal Information collected about you, including the source of your Personal Information, whether your Personal Information is sold or disclosed and the purpose, and with whom your Personal Information was disclosed;

  • To request deletion of Personal Information, if permissible by law

  • To correct inaccurate Personal Information we retain about you;

  • To opt-out of “sale” and/or “share” of your Personal Information, targeted advertising, and profiling

  • To opt-out of profiling in furtherance of a legal or similar significant effect.

  • To limit the use of your sensitive Personal Information;

  • To nondiscrimination based on the exercise of your privacy rights; and

  • To appeal a decision regarding your request.

Exercising Your Right to Know, Delete, and Correct
Depending on where you live, you may exercise the right to know (sometime also referred to as the right to access), delete and correct your Personal Information. To do so, please submit a verifiable request by contacting us at info@noon.energy.


Opt-Out of Sale, Share, and Targeted Advertising 
We and our third–party partners and service providers (such as advertising and analytics providers) use pixels, web beacons, software developer kits, third–party libraries, cookies, and other similar online tracking technologies (collectively, “online tracking technologies”) to gather information when you interact with our Services. These online tracking technologies are deemed to be a “sale” / “sharing” / “targeted advertising” under applicable U.S. state laws. Depending on where you reside, you can opt-out of these online tracking technologies by selecting “Reject All” button in our cookie preference center. You can opt out of the marketing by going to the Settings page or by emailing us at info@noon.energy. Please note, some features of our Site or Services may not be available to you as a result.

We do not knowingly sell or share Personal Information of consumers under 16 years of age.


The Right to Opt Out of Profiling in Furtherance of a Legal or Similarly Significant Effect
You have the right to opt out of the processing of personal data for purposes of profiling in furtherance of a decision that produces a legal or similarly significant effect. To opt out, please send an email to info@noon.energy.
 

Right to Limit Use and Disclosure of Sensitive Personal Information
As mentioned above, if you provide us with sensitive personal information, we may collect that sensitive personal information, as defined by applicable privacy laws, for the purposes allowed by law or with your consent. We do not collect or process sensitive personal information for the purpose of inferring characteristics about you.


Some of the purposes for the collection and processing of sensitive personal information allowed by law include: to perform the Services; to prevent, detect, and investigate security incidents; to resist malicious, deceptive fraudulent, or illegal actions directed at us and to prosecute those responsible for those actions; to ensure the physical safety of natural persons; for short-term, transient use; and to perform services on behalf of Noon Energy.

You may otherwise limit our right to use of sensitive personal information and you may request that we delete it.


Right to Non-Discrimination
You have the right not to receive discriminatory treatment for exercising the privacy rights.
 

Appealing Requests
Depending on your state of residence in the U.S., you may be able to appeal our decision to your request regarding your personal information. To do so, please contact us in any of the ways listed in the “What If I Have Questions or Concerns?” section. We respond to all appeal requests as soon as we reasonably can, and no later than legally required.


Our Retention of Your Personal Information
We will retain your Personal Information for as long as needed to provide you with the Service and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.


Other Californian Privacy Rights

California’s “Eraser Button” Law
If you are a California resident under 18 years old and a registered user of our Services, you can request that we remove content or information that you have posted to our Services. To request removal of content or information, please contact us at info@noon.energy.
 

European Residents

If you are based in the EU, EEA, or UK, we will only process your Personal Information for a purpose described in this Privacy Policy if we have a lawful basis for doing so.  Our lawful basis will generally be that either:

  • you have provided your consent (which can be withdrawn at any time);

  • the processing is necessary for the performance of a contract we are about to enter into or have entered into with you (e.g., our Terms of Service under which we provide the Services to you);

  • we are required by law to undertake such processing; or

  • the processing is necessary for the purposes of our legitimate commercial interests (except where such interests are overridden by your rights and interests).  Our legitimate commercial interests will be those processing purposes set out in this Privacy Policy, for example: to improve the efficiency and effectiveness of our Services, to monitor the use of our Services, to prevent fraud and enhance the security of our systems, to conduct business analytics and research, to market and promote our Services, and to manage and grow our business (including in the event of a sale or reorganization of all or part of our business).


If you are based in the EU or UK, in certain circumstances you have rights under data protection laws in relation to your Personal Information that we hold about you—specifically to:

  • Request access to your Personal Information.  You may have the right to request access to any Personal Information we hold about you as well as related information, including the purposes for processing the Personal Information, the recipients or categories of recipients with whom the Personal Information has been shared, where possible, the period for which the Personal Information will be stored, the source of Personal Information, and the existence of any automated decision making.

  • Request correction of your Personal Information.  You may have the right to obtain without undue delay the rectification of any inaccurate Personal Information we hold about you.

  • Request erasure of your Personal Information.  You may have the right to request that Personal Information held about you be deleted. 

  • Object to our processing of your Personal Information. You may have the right to object to our processing of your Personal Information, in certain circumstances.

  • Request restriction of processing your Personal Information.  You may have the right to prevent or restrict processing of your Personal Information.

  • Withdraw your consent. You may withdraw your consent to our processing of your Personal Information at any time (which will not impact the legality of any previous processing based on such consent).  Note that we may continue to process your Personal Information where consent is not the legal basis relied upon.

  • Request transfer of your Personal Information.  You may have the right to request transfer of your Personal Information directly to a third party where this is technically feasible.


You also have the right not to be subject to automated decision-making which produces legal or similarly significant effects.  For more information about our automated decision-making practices, see above.

Where you believe that we have not complied with our obligations under this Privacy Policy or European data protection law, you have the right to make a complaint to an EU Data Protection Authority or the UK’s Information Commissioner’s Office (“ICO”). 


You are not required to provide us with any Personal Information but if you do not provide us with necessary Personal Information, we may not be able to provide you with the Services.


What Choices Do I Have Regarding My Information?

  • You can use many of the features of the Services without registering, thereby limiting the type of information that we collect.

  • You can always opt not to disclose certain information to us, even though it may be needed to take advantage of some of our features.
     

What Happens When There Are Changes to this Privacy Policy?

We periodically review this Privacy Policy and may make updates from time to time to reflect changes in our practices, for legal reasons, or to meet new regulatory requirements. If we make changes in the way we collect or use information, we will notify you by posting an updated Privacy Policy. Your continued use of the Services following any such change indicates your acceptance of such change.


International Transfers

We are headquartered in the United States.  Please be advised that your information will be accessed by us or transferred to us in the United States or to our affiliates, partners, or service providers who are located worldwide.  If you are visiting our Site from outside the United States, be aware that your information will be transferred to, stored, and processed in the United States where our servers are located, and our central database is operated and where laws regarding processing of Personal Information may be less stringent than the laws in your country. 


Where required by applicable law, we will seek to ensure that any onward transfers of Personal Information are subject to appropriate safeguards, such as standard contractual clauses approved in accordance with relevant law.  For more information about any specific transfers, or the safeguards in place in relation to such transfers, please contact us using the details below.
